I do feel sorry for the injured woman, but it sounds like the guy just slammed on the rear brake and lost control of the bike. That's not Harley's fault; and neither is the fact that the helmet (if the passenger was wearing one) didn't prevent the brain injury. Was this one of those crap nazi style hats that's more of a head ornament than a safety device? Did the owner of the bike recommend she wear a REAL helmet or provide her with one? The owner of the bike f'ed up and crashed - what makes him believe ABS would have prevented him from making a mistake or would have compensated for his poor riding skills? Why didn't he simply slow down in a normal, controlled fashion when he saw heavy traffic ahead? Was he not paying attention?

Having said all that, Harley or any other manufacturer shouldn't put an ABS icon on a bike that does not have ABS. That's just stupid! The bike costs a ton of bucks, so how much would it cost Harley to have different panels for ABS equiped bikes and non-ABS equiped bikes; maybe $5? Who is the genius accountant that decided this was a great cost cutting measure?

Why isn't the guy suing the helmet manufacturer? Or the tire company? Or the state for issuing him a license when he doesn't know enough about his own motorcycle to safely operate it?

Sounds like another moron trying to get rich for nothing, alot like the person that sued McDonald's because the coffee cups didn't have a warning saying the contents were hot. I feel bad his wife got hurt but maybe he should sue his parents for not telling him he was a fawking retard.

Not everyone should drive, much less drive a motorcycle.

Its sad to hear anyone hurt in a motorcycle related accident. I have lost a few freinda and several aquaintences throughout the years,

but with that said. the transportation manufactures have put intrument lights guages switches and panels in place for years for the higher end model or dealer upgrades

I am pretty sure every drivers education course on the planet has a section on inspecting all safety eqiptment before use. and in 15000 miles I would have had a look at my antolock braking system

if for nothing else to brag to my friends how far these bikes have come. I'm sure he was sitting in the hospital eating his wifes green jello watching TV when a comercial for dewie suem and how came on.

After my first divorce I was dating a girl who just received a large settlemnt from her own insurance company for her previous boyfriend driving her car during an argument and accidentally running over her foot.

We live in a world of blame someone else for what happens to us, and there is a dozen personal injury lawyers telling us why we should.

Personally It has never even occured to me to sue anyone for their negligence. Generally it's me asking "hey is this safe? Oh well let me try it"
