Off-Duty Cop Kills Biker was created by Sandy
And he(the Cop) was impaired at the time.
He was charged and released...go figure.
Suspended WITH pay.

This makes me ill.
His first court appearance in January 15th,so I'll have to wait til then to see the pathetic outcome.

This same Cop was one of the 4 that tazered that poor guy at Vancouver International Airport...the tazering that killed Robert Dziekanski,a couple years ago, when he was moving to Canada to be with his Mother.

If he DOES get time,I really doubt he'll be put in general population.
He'll probably end up on some cruise-ship,for punishment.

I really think that there is irony in this. A cop who is impaired should get a double dose of punishment under the law.

How could you even look at your face in the mirror?

I wouldn't be able to live with myself.

same thing happened here last year.
off duty sherrif was THREE times the legal limit and pulled out of the country club parking lot right into the path of a father of three on his way to work.
they blamed it on the biker going over the posted limit of 40 mph.
nevermind there were a bunch of people who said he was there all day drinking.

guess what happened to him?
not a damn thing!
he signed everything over to his wife and resigned from his job so the family wouldn't get anything.

the judge ( who btw was at the same party) found him not guilty of neigalant homicide but of a MISTERMEANER dwai charge.
he got probation and the family lost their father/husband.
the justice system don't work if you have friends in high places or a lot of money.

someday i will be able to afford my kz habit.

Not ignoring the fact that this was an officer-involved incident, but the horrible part is that an innocent person (a fellow m/c rider, and one so young at that) lost their life. :(

Prayers and well wishes to the Hutchinson family in being able to deal with this tragedy.

I'm no scholar by any means, but there are a lot of decisions and statements made by the RCMP that are outright hypocritical to what they (or any law enforcement officials for that matter) are employed to do:

Hutchinson, who was thrown from his bike, suffered traumatic injuries and was pronounced dead at the scene.

The driver of the Jeep, an RCMP member, was transported to Delta police headquarters where, according to Delta police, he failed a breathalyser test.

I don't care who you are, if you fail any form of "field sobriety test" here in California charges of DUI are automatically brought against you and you'll spend at least a few hours behind iron bars (the entire weekend if you're brought in late Fri night/early Sat morn), with an official court hearing set for a later date.
Factor in that there was a death involved, and unless you have deep pockets or friends in high places (or are a celebrity:angry: ) you will stay jailed until your appointed hearing date. However, with the horrible track record the legal system in Calif has had over the past 10+ years, an incident like this could likely be swept under the carpet here as well.

The officer was released on a promise to appear in Surrey Provincial Court on Jan. 15, 2009.

Delta police say they expect the officer to be charged on that date with impaired driving causing death and driving over the legal limit, though he could also face additional charges.

I could give a crap less they feel that he's not a flight risk, their wording in the above statement basically says they know he's guilty. If it were the average citizen, that person would be locked up until their official court hearing, or at the very minimum required to post a hefty bond to be released until that time.

Knowing that the general public would likely be outraged by what appears to be preferential treatment of "one of their own" for something that (from the info given thus far) he's obviously guilty of, the RCMP just gave itself a major black eye here.

Not all law enforcement officers/departments operate like this, but all it takes is one such incident to make them all crooked/inept in the public's eyes (for comparison: a group of sport bike riders are reported stunting and driving recklessly on public streets, immediately ALL m/c riders become labeled as reckless).

in canada the law is supposed to be the same you get pulled over for an impaired your licesnce is removed from you on the spot and you are taken down for pictures and prints and you are supposed to be incarcareted for a time well the do up the charges.but like all business you watch out for your own. there are two set's of rules. sad but true.
