But when i look at this photo i see that the conection points are not in line, mine are now inline and the sidestand sits in front not behind the footrest

Out of a morbid curiosity, I checked the 'frame' diagrams at Partzilla. It looks to me like the 440LTD frame has the footrest mounting points in line, like yours. The regular 440(B1/B2) frame appears to have offset footrest mounts.
I could be out of my mind, but could that be part of it? You have footrests for the "other" 440 frame?
