Lots of racers only use 3 quarts in their motors. That keeps the oil level off the crank for more HP. How that would work for the street, I don't know but if it can stand up to that stress, it would probably be fine on the street. I wouldn't worry about that too much as long as it's in the middle of the sight glass.
