Got rear ended today!!

Well it was a beautiful morning to be out on the bike today, wore a bright orange T-shirt to be noticeable, it sure did not help. I came to a stop at a traffic light, next thing I know I have the front bumper of a 2012 Dodge ATV hit the rear fender of my bike and push me forwards 15 feet, I tried as best as I could to not loose the bike, but I finally had to lay her down, I could not hold her up with my left arm alone. I was really lucky that my guardian angels were with me, I was on my way to visit my mother at the cemetery, the damage on my bike can be fixed, I have a spare bike for parts, my left upper body and right lower back hurts like hell, nothing broken thanks God, time will heal me, as I write this I am feeling pretty good after a couple of Tylenol 3 and a bottle of wine, I am sure the pain will be worse tomorrow. What really pisses me off, is the cop that came to the scene was too lazy to charge the guy, he said it is too much paper work and that he is already at fault and in deep, there are no witnesses and that I looked okay and charging him would not make a difference in my case,,,, What does one have to do die, in order to get charged? Can you believe this? Anyways I am going for therapy and I do plan to sue this guy as he said he lost concentration for a split second, he thought I was going to run a red light, I wonder if the cell phone had something to do with it?

What kind of stupid ass cops do you guys have?

Glad you are still with us. Seems like it was only yesterday I was being scraped off the pavement. No , Im wrong, It was June 7th. $12,000.00 Dollars so far in medical expenses and more on the way to be paid by the girl who hit me insurance company.
You need a better Doctor if all you got are tylnol 3s. My Docs are keeping me well lubed

As for that Cop. Well you need to report him to his superior officer, file a report yourself at the station, with his name/ badge # if you got it. That cop needs to be suspended, hopefully without pay, as a punishment. After all this is Exactly why we supposedly have these patrol officers out there on the roads.
There are So many distracted drivers out there these days. Even if they can't prove the cell phone angle, the driver was probably using a gadget of some sort.
Be careful out there everyone!

The sooner you file a report with the police department, the better.
The only way people will learn is if there are legal & financial consequences.

Don't worry too much about the guy not getting charged. When I was hit by a truck, I had to point out to the cop that there was a "No Left Turn" sign for the other guy. It was actually lit with neon to be visible. The cop hadn't noticed it at the scene, so from the hospital I had to ask him to go back and check it out. He did, and then wrote the guy a ticket. I was glad he gave the other guy a ticket, but my lawyer later said the ticket would not matter at all. He was right. The truck driver's company ended up paying for everything. Just make sure you have a good lawyer.

I'm glad you are not badly hurt! Start a notebook today and keep a detailed record of all of the expenses and time you have to invest in this accident.
